For @wizardmanperson@poa.st and my non-german frens, so you guys know, how bad things in Germany really are.
Under German law, recognition of the State of Israel is directly linked to nationality law (naturalization) as well as current legislative initiatives to criminalize the denial of the right to exist. Diplomatic recognition under international law traditionally takes place at the political level and not through a single law passed by the Bundestag.
Important Legal Provisions and References:
Naturalization and Nationality Law: Since the reform of the Nationality Act (StAG) in June 2024, a commitment to Germany’s special historical responsibility - including the protection of Jewish life and the right of the State of Israel to exist - has been an explicit prerequisite for naturalization. The official naturalization test includes questions on this topic.
Criminal Law and the Right to Exist: The Federal Council has introduced a bill that would make it a criminal offense to publicly deny Israel’s right to exist or to call for its destruction, provided that such actions are linked to a willingness to commit anti-Semitic violence.
Background: Diplomatic relations and treaties between Germany and Israel (such as the mutual legal assistance treaty) have been governed by various laws and agreements over the decades; however, the right to exist is legally enshrined primarily as part of Germany’s national interest and through the requirements for naturalization.
